Germany offers three main options for work assignments:
Residence Permit for Employment Purposes
This scheme is the most commonly used in Germany and is for non-EEA/EFTA nationals allowing them to live and work in Germany as local hires or assignees.
Blue Card (Blaue Karte)
A Blue Card is an EU wide scheme designed for highly skilled employees holding higher professional qualifications. The scheme was implemented in 2012 for such employees who have a confirmed job offer and a salary at least 2/3 (two-thirds) of the German pension fund contribution ceiling (“Beitragsbemessungsgrenze der Deutschen Rentenversicherung”), which changes marginally every year.
Van der Elst Visas
Such visas may be granted to non-EU individuals who hold a current, valid work permit for another EU member country and will be assigned to work in Germany for up to two years. One of the main conditions is that an assignee must have been employed in the other EU country for a minimum period of one year and the employer must intend for them to return to that country following completion of their German assignment.
Can you enter and work in Germany as a Visitor?
Nationals from specified countries can enter Germany without a visa for tourism and business purposes, for short trips and restricted activities. Other nationals can enter Germany on a business visa, for a short trip, to carry out business activities.
It is important to note that it is strictly prohibited in Germany to carry out any work-related activities on a business visa or under the visa-waver agreement for non-EU nationals. Therefore, an individual may look for jobs, however they can only commence any form of employment until they have acquired appropriate work authorisation. If in doubt, please check with Hudson McKenzie before you travel to find out whether you need a work permit to undertake proposed activities.
An individual who is currently in Germany as a visitor must also leave the country and apply for a work permit in their home country or another country where they hold a long-term residence permit prior to re-entering Germany for work purposes.
