New ILR absence requirement for PBS Dependents | Hudson McKenzie

Effective 11 January 2018, PBS dependents who wish to apply for Indefinite Leave to Remain will also be subject to the 180-day absence rule.

This means that after 5 years of lawfully being in the UK for a continuous period, partners of Points Based System migrants must meet the requirement of no more than 180 days absences per year in order to qualify for settlement, which currently applies to main applicants.

The requirement will only apply to partners who have been granted leave to remain as a PBS dependent following an application made on or after 11 January 2018.

PBS dependents who travel abroad frequently will need to be mindful of their absences and ensure they monitor the number of days they are outside the UK.
