Updated USCIS forms for Adjustment of Status and EB-5 Investors
Effective from 28th May 2025, USCIS will only accept the 20th January 2025 editions of several critical immigration forms, including those related to permanent residency and the EB-5 immigrant investor program. Specifically, the new versions apply to:
- Form I-698: Application to Adjust Status from Temporary to Permanent Resident
- Form I-526: Immigrant Petition by Standalone Investor
- Form I-526E: Immigrant Petition by Regional Center Investor
- Form I-829: Petition by Investor to Remove Conditions on Permanent Resident Status
Until 28th May, applicants may continue to use the 1st April, 2024 versions of these forms. Individuals and legal representatives are encouraged to verify the edition date on the form’s lower page to ensure compliance and avoid processing delays.
REAL ID enforcement at TSA checkpoints
As of 7th May 2025, the Transportation Security Administration (TSA) has begun enforcing the REAL ID requirement at airport checkpoints nationwide. Travellers using state-issued identification must now present a REAL ID-compliant document or face enhanced screening procedures.
According to DHS, approximately 81% of travellers are already compliant, and no significant disruptions to wait times are anticipated for prepared passengers. U.S. passport books and cards remain valid alternatives and can be used for domestic travel in lieu of a REAL ID. Passengers unsure of their ID’s compliance should consult the DHS REAL ID webpage for state-specific guidance.
New online tool for interview updates
The Department of State has rolled out a new Immigrant Visa (IV) Scheduling Status Tool designed to offer greater transparency for applicants awaiting visa interviews at U.S. embassies and consulates. This resource enables users to check when the National Visa Center (NVC) is scheduling interviews based on the submission of required fees and documentation.
The tool does not apply to all visa types, such as Diversity Visas, Afghan SIVs, or certain waiver and adoption cases, but provides clarity for most employment-based and family-sponsored applicants. It complements recent enhancements to the Global Visa Wait Times page, which now includes a filterable interface for viewing average wait times by visa category and post.
