United States: The Department of Homeland Security (DHS) recently evaluated whether H-1B holders should be prevented from extending their status beyond the six-year mark, as allowed by the AC-21 Act.
The American Competitiveness in the 21st Century Act (AC-21) currently allows H-1B holders to extend their status until their green card backlogs clear.
Following from this, if the DHS approves regulations to prevent the extending the status of H-1B holders, then many individuals who have been waiting years for their backlogs to clear would be forced to leave the U.S.
However as for now, H-1B holders may still continue to request extensions under the AC-21 act until further information is provided, regarding the update upon the DHS evaluation process.
